The problem with the courts is the concept of “judicial review”

Most of what people do not like about court rulings comes from the concept of “judicial review”.

The main problem with the concept of “judicial review” is that it is extra-Constitutional.  It does not exist in the Constitution.  The Supreme Court made it up in the early 1800’s.  It was never added to the Constitution through the process outlined in Article V.

The Constitution does not give the courts the authority to review laws or give rights.  The courts only have Constitutional authority to interpret what laws apply in specific instances.  They are not Super-Legislatures.  Only Legislatures can create laws.
