Supreme Court violates Constitution again!
Today the Supreme Court ruled that a Louisiana law providing the death penalty for people rape children. It used the 8th Amendment as its justification. But what does the 8th Amendment really say?
“Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
Note the amendment says “cruel and unusual punishments” not “cruel or unusual punishments”. In order to violate the 8th Amendment a punishment must be both “cruel and unusual” not “cruel or unusual”.
The real problem with the court ruling is that the concept of “judicial review” violates the Constitution. “Judicial review” is nowhere to be found in the Constitution. It is an authority created by the Supreme Court in the 1803.
“Judicial review” makes dictators of the majority of the Supreme Court. They can make laws just by dictating them.
